Are you a gallery interesting in displaying and retailing Jake Beckman's art?
If so you should know that for the duration of any display, AKAJake retains the listing for the individual works, but refers all potential sales leads for that work to your venue.
AKAJake will provide a listing for your establishment with its own page under Shows & News. The listing will contain such information as what is showing, duration of the event, how to get there, hours of operation, contact information, and even a link to your website.
AKAJake will note your consigning role on pages for individual works and on the applicable thumbnail gallery portfolio pages.

- Many of these terms that follow are negotiable as long as agreed to in advance by both parties.
- In the preamble the name of the Gallery and Artist shall be listed along with the names of any agents, business addresses, contact phone numbers etc. If the Gallery is a holding company with no assets, the Artist will require an entity with assets guaranty the contract as signer.
- The Gallery acknowledges the receipt on consignment of the Work(s) listed on the Attached List all in good condition.
- The Gallery agrees to return any Work unsold in the condition received at the end of the show on ____.
- The Work(s) will be available for pick up after _____ on ______ .
- The Gallery shall insure the Work(s) on the Attached List for the duration of the consignment for the appropriate value.
- In the event something happens to the Work(s) on the Attached List the Gallery will pay for the Works at ____% of the Selling Price Excluding Sales Tax as set out on the Attached List.
- If the Artist is not paid for the Work(s) and the Work(s) are not returned, the Work(s) will be listed as stolen.
- The Work(s) are consigned to the Gallery for purposes of sale only
- The Gallery is responsible for collecting payment, which includes the sales tax along with the price of the art in accordance with the Attached List.
- The Gallery will sell the Work(s) as agent for the Artist at the selling prices set out on the Attached List including the Sales Tax.
- The Gallery will be entitled a ___% sales commission on the Selling Price Excluding Sales Tax as specified on the Attached List.
- The Gallery will pay the Artist ___% the Selling Price Excluding Sales Tax with ____ days of the sale.
- The Gallery is responsible for paying the sales tax collected to the appropriate taxing entity.
- If payment by the Gallery is made by check, the check is to be made out to Susan Beckman. Payment by the Gallery must be written on a bank having branches or affiliates where the Artist can cash said check immediately within the Phoenix Metro Area. There will be a $30 bounced check fee for returned checks.
- The Artist retains ALL copyright and reproduction rights.
- The Artist may withdraw any of the Work(s) on seven days notice via email, phone conversation or written notice. The Gallery may return to the Artist any of the Work(s) on seven days notice via email, phone conversation or written notice.
- If the Work does not have a frame the work is sold unframed.
- The Gallery assumes responsibility for delivery, shipping and handling unless otherwise agreed to in writing.
- Any amendment to this contract must be in writing and signed by both parties.
- If the Gallery is a holding company or other entity with no assets, the Gallery's agents under this Agreement must personally guaranty the Agreement.
- This Agreement constitutes the entire agreement and understanding between the parties.
- This agreement is a single delivery agreement and there is no further obligation to perform in a similar fashion subsequent to this agreement.
- This Agreement shall be governed by Arizona law and both parties agree to submit to the non-exclusive jurisdiction of the Arizona Courts.
- The Artist reserves the right to require mediation as a means of settling any dispute before resorting to the jurisdiction of the courts. The Artist retains ownership of the Works until paid in full.
- If the Gallery declares bankruptcy at any time during the consignment and the works are sold, ALL proceeds from the sale of the Work(s) during the bankruptcy process go directly to the Artist and NOT to any other creditors the Gallery may have. If the works are unsold they shall be returned to the artist by the gallery before declaring bankruptcy.
- This consignment agreement does not convey any rights of exclusivity regarding the Artist or the Work(s) to the Gallery or its representatives.
- The Artist gets paid first in any transaction involving any sales of the Work(s).
- This Agreement is personal as between the parties and may not be assigned or transferred by either party without the prior written consent of the other.
- Neither party shall be liable for any delay or non-performance of any of its obligations if the same is due to Act of God, act of any government or other authority, fire, explosion, flood, power failure, strikes or other industrial action or any other cause beyond its reasonable control.
- Time is of the essence of this contract.
- The waiver or forbearance of any party's rights to insist on strict performance of any contract term shall not be deemed or construed as a waiver of that party's right to future performance, or any subsequent breach.
- The Artist warrants that he/she is the creator of the Work and the Work is original, or in the case of a reproduction, that the reproduction is of a Work that is original and that the artist is the creator of the reproduced and original Work.
- The Gallery and Artist both warrant that they are in compliance with all Federal, State and Local laws.
- There are no implied or other warranties in this agreement save compliance with Federal State and Local laws and the Artist's authorship of the Work(s) as already stated herein.
- A pre-existing relationship between the Artist and the Gallery does not imply forbearance or other agreements or warranties not contained herein.
- Invalidity or unenforceability of one or more provisions of this Agreement shall not affect any other provision of this Agreement.
- This Agreement shall be binding on the parties and their respective heirs, successors and assigns.
- All notices shall be sent in writing to the parties at the addresses listed in this Agreement.
